Q: Can I sell my Electrical Equipment in Australia if I don’t have a local office?
A: ERAC in-scope equipment cannot be legally sold without a local entity (ABN holder) registering as a Responsible Supplier. The local entity can however appoint an “Authorised Representative” to act on their behalf.


ERAC EESS Authorised Representative
For legal sale of all in-scope electrical and electronic products a local entity (ABN holder) must register as a Responsible Supplier. Overseas entities are not allowed to register as a Responsible Supplier per ERAC rules.
ACMA Agents are also not allowed to register as ERAC Responsible Suppliers.
However, ERAC does allow a Responsible Supplier to appoint an ERAC EESS Authorised Representative who can act on behalf of the Responsible Supplier to make declarations, register products on the ACMA/ERAC database and arrange electrical safety compliance and certification.
An ERAC EESS Authorised Representative service is initiated with a simple, one time contract. Services for each project are charged based on project specific requirements. For new customers with simple devices the initial contract fee may cover the necessary compliance activities.

How ERAC Authorised Representation Works…

Step 1
Prepare and sign a Contract to act as an ERAC Authorised Representative (one off contract)

Step 2
Analyse Existing Paperwork (Such as CE LVD Safety Reports, CB reports & Certificates, Existing Australian Safety Certificates) and Equipment Specifications to work out ERAC requirements

Step 3
Review and validate existing safety test reports, arrange testing where gaps exist, arrange certification if necessary

Step 4
Prepare and sign ERAC Declaration, register equipment on the database, prepare and maintain Compliance Folder, label the device with the RCM, sell the equipment legally!
